President Dick Cheney George W. Bush has done it, he's commuted the sentence of convicted felon Scooter Libby...

STATEMENT BY THE PRESIDENT

The United States Court of Appeals for the D.C. Circuit today rejected Lewis Libby's request to remain free on bail while pursuing his appeals for the serious convictions of perjury and obstruction of justice. As a result, Mr. Libby will be required to turn himself over to the Bureau of Prisons to begin serving his prison sentence.

I have said throughout this process that it would not be appropriate to comment or intervene in this case until Mr. Libby's appeals have been exhausted. But with the denial of bail being upheld and incarceration imminent, I believe it is now important to react to that decision.

From the very beginning of the investigation into the leaking of Valerie Plame's name, I made it clear to the White House staff and anyone serving in my administration that I expected full cooperation with the Justice Department. Dozens of White House staff and administration officials dutifully cooperated.

After the investigation was under way, the Justice Department appointed United States Attorney for the Northern District of Illinois Patrick Fitzgerald as a Special Counsel in charge of the case. Mr. Fitzgerald is a highly qualified, professional prosecutor who carried out his responsibilities as charged.

This case has generated significant commentary and debate. Critics of the investigation have argued that a special counsel should not have been appointed, nor should the investigation have been pursued after the Justice Department learned who leaked Ms. Plame's name to columnist Robert Novak. Furthermore, the critics point out that neither Mr. Libby nor anyone else has been charged with violating the Intelligence Identities Protection Act or the Espionage Act, which were the original subjects of the investigation. Finally, critics say the punishment does not fit the crime: Mr. Libby was a first-time offender with years of exceptional public service and was handed a harsh sentence based in part on allegations never presented to the jury.

Others point out that a jury of citizens weighed all the evidence and listened to all the testimony and found Mr. Libby guilty of perjury and obstructing justice. They argue, correctly, that our entire system of justice relies on people telling the truth. And if a person does not tell the truth, particularly if he serves in government and holds the public trust, he must be held accountable. They say that had Mr. Libby only told the truth, he would have never been indicted in the first place.

Both critics and defenders of this investigation have made important points. I have made my own evaluation. In preparing for the decision I am announcing today, I have carefully weighed these arguments and the circumstances surrounding this case.

Mr. Libby was sentenced to thirty months of prison, two years of probation, and a $250,000 fine. In making the sentencing decision, the district court rejected the advice of the probation office, which recommended a lesser sentence and the consideration of factors that could have led to a sentence of home confinement or probation.

I respect the jury's verdict. But I have concluded that the prison sentence given to Mr. Libby is excessive. Therefore, I am commuting the portion of Mr. Libby's sentence that required him to spend thirty months in prison.

My decision to commute his prison sentence leaves in place a harsh punishment for Mr. Libby. The reputation he gained through his years of public service and professional work in the legal community is forever damaged. His wife and young children have also suffered immensely. He will remain on probation. The significant fines imposed by the judge will remain in effect. The consequences of his felony conviction on his former life as a lawyer, public servant, and private citizen will be long-lasting.

The Constitution gives the President the power of clemency to be used when he deems it to be warranted. It is my judgment that a commutation of the prison term in Mr. Libby's case is an appropriate exercise of this power.

Well, that can only mean one thing.        Paris Hilton, having served some actual time, has more Street Cred, than Scooter Libby.  Or the President, for that matter.  Whoever the real President is.  Of course, if President Bush and President Cheney were to surrender to the War Crimes COmmision in the Hague, and serve their time, then They would have more Street Cred than Paris Hilton.  Which means they could release a Rap Album under the stage name "X KHAN".

Unbelieveable...the presidency goes from bad to worse. It increasingly seems that justice and the rule of law have no place under this administration.
These are dangerous times.  Watch for a coup.

Well, at least Libby wasn't pardoned, and I liked the wording of the statement. All in all, I can live with this decision by the President (says someone who thinks both Bush and Cheney should be impeached...)
What is to be expected from an administration that has made lying, stealing and just plain breaking the law a hallmark of their political "capital". 3,500 of our brave soldiers plus who knows how many Iraquis have died just on a whim of this sorry president and vice president. They all should be impeached and sent to jail. May they rote in hell.

I know this is Rush Olbermann's blog and it will reflect the quality journalism he performs that is based on facts, multiple sources and corroboration (Sarcasm is difficult when it is the written word).  Will someone show me evidence that has been found that there ever was a conspiracy to out Plame?  Especially evidence that involves the President of The United States?

Anyone?

I am asking for facts, not opinions of how nasty Karl Rove is or how diabolical Dick Cheney has become.  Has someone else been indicted that I am not aware?

Please people, some perspective and nonemotional analysis would be a nice change on this site.  Oh, I forgot again, you all like Rush Olbermann so that will make that request IMPOSSIBLE!
Now that my first prediction has been proven true (Scooter will not serve prison time)you can rely on my second. The negotiation for the next President of the USA is over and the big three have bought Hillary Clinton. So keep on analyzing and guessing the 2008 Presidential election has been decided.
No one, and I mean no one should be at all surprised.  The man has no morals or virtues.  He has no problem letting an 18 year old black kid go to jail for 10 years for receiving a blow job and he has no problem letting 2 hispanic border patrol agents go and rot in jail for actually securing our borders for 11 and 12 years respectively, for shooting a drug smuggler.  Gee, I wonder if these "criminals" were white would they have a President Bush to intervene.

Oh and lets not forget that it was the lowest ranking, enlisted people, not the senior officers and senior leadership (Bush, Cheney, Rumsfeld, Gen. Abizaid) that get to go and rot in jail for the Abu Ghraib scandal.  I guess Bush's signing statement allowing him to allow torure to happen regardless of the what the law states doesn't cover those that actually are being forced to do it by their superiors.  

Now, anyone want to guess how the Democratic leadership will respond?  My money's on feigned indignation and empty rhetoric?  Any takers???

I can't even watch the news tonight. The country I grew up in doesn't exist anymore. Special comment? We need one now more than ever.
Just when I don't think it can get much worse!  This sure shows how he took the situation seriously & will punish those who are found to be responsible.

I've always believed Libby is the scapegoat & took the fall for others, but commuting his sentence is going too far.

Richard Amritage outed Valerie Plame and this fact was known to Colin Powell AND Patrick Fitzgerald even as the special counsel set the perjury traps.  Fine.  Dog-eat-dog politics works both ways. I accept it and so should all the whining democrats.

Judging by your post I question your ability to separate fact from opinion, or even accept facts as facts, but lets see what we can do.

First off, Libby was convicted for perjury.  If you keep track of the news, you would know that the jury was extremely sympathetic towards Libby, in a statement they even said he was the fall guy for others in the administration, but that they had no choice but to convict him on a good number of the accounts because the evidence that was presented showed that he had lied under oath.  In the latest appeal today before Bush commuted his sentence, the judges unanimously agreed that Libby should go to prison and not wait pending appeal.  The system of law worked, until Bush stepped in and commuted his sentence.

Now, as for the outing, there is no argument now that Plame was not under cover.  Information from the CIA was released that stated so, and thus someone or a group of people undermined our national security by outing Plame and thus committed a crime against our country.  There is ample evidence that when Wilson published his article that challenged this administrations assertions about Saddam, and with facts that the administration didn't want to be known, evidence shows parts of the administration were obsessed with trying to find a way to discredit Wilson.  If I remember correctly, Cheney even had a copy of the article with notes scribbled along the margins indicating a need to discredit Wilson.
They chose to do this by leaking Plames identity to the press and trying to claim that she sent her husband on this quest for information.  This of course is untrue since it was Cheney who requested the information (specifically about yellow cake i think it was from Niger?) and Plame was not in a position in the CIA where she could authorize her husband being appointed to collect this information, all she could do was suggest.
Now, this all comes back to Libby who was brought up on perjury charges because he protected this administration by not giving the information that would have allowed for prosecution of those traitors of our country who undermined our national security by outing one of our own agents.
While, I think this latest development is a disgrace I can honestly say that I am not surprised or disappointed.
From the day that Bush took the oath of office I have expected nothing good from his adiministration. Well, folks guess what? The counterfiet cowboy has once again come through. He has not disappointed me. In fact he has a perfect batting average.
Is anyone surprised by this action? I'm just mad at the timing-this piece of human refuse waited until congress was out for the holiday. He's a coward from head to toe.

Bush pardons Libby?  Who was surprised by that?  These guys are thieves plain and simple and even thieves have a code of honor. The average American is pretty stupid, clueless to what is going on so who's to blame?  Americans are LETTING these cockaroaches steal their money.  Keep the populace poor and uneducated and they are easy to lead.  Hell you don't have to be poor, just struggling.  Folks are working so hard they don't have time to pay attention to how the country is being looted.  America's founding fathers are spinning wildly in their graves.
As a registered Republican, I continue to be embarassed by this administration! Maybe 30 months in prison was excessive for lying. However, I could have accepted President Cheney having Doubl-ya comute 24 of the 30 months prison sentence and $125,000 of the fine. Libby should have served some time! (Which Libby won't have to pay anyway - - isn't that so President Cheney??)
I guess I entered the wrong profession.  I should have become a Washington politico and sought fame and fortune by being an absolute nerd under such an administration.  I taught and worked in education for over 47 years.  I was aiming for 50 when a complaint was filed (I had used the F word inappropriately) and I was asked to leave.  I was stunned.  It turned out later that the person who complained was a bit neurotic but my days were numbered.  Oh, I consulted a lawyer and learned what i could get out of all if it.  It wasn't worth it.  I have known people to sue and win, and yet, they lose.  I just opted to retire "gracefully."  Yeah, right!

Would you believe that five years later, the person who filed the complaint called me and asked for my help!  I was flabbergasted.  But I digress.   I should have been in the Bush administration.  I could write a book, get exonerated for being misunderstood and the whole shebang.  Am I being silly.  Perhaps.  But I do wish that the American public would quit ignoring what the hell is happening and start to demand some accountability.  But they will climb into their Hummers and ignore the scene.  Cheers, I think

Hell, since it is Independence week, how about just plainly call for the Dem leadership to start impeachment proceedings?  The moron President gives a get out of jail free card to a man directly tied to an investigation that leads to his office. When I saw this "breaking news" on another site, I had to come back to my News Hole family to attend the wake held in the honor of Lady Justice.

No one. NO ONE in the entire world knows how to game the legal system like this bunch of criminals in the WH.

I am not a conspiracy theorists but here is what I think about this.

1) At any time up to trial (and maybe even up to sentencing) Mr. Libby could have come clean and admitted his obstruction. He did not.

2) At any time during the investigation, trial, and sentencing, Mr. Libby could have been in contact with the WH who could have told him to go ahead and tell the whole truth. They did not.

3) Ms. Libby made a startling comment after sentencing that Mr. Libby would not go down alone.

4) The administration allowed the appeals to go forward to give other Rs the chance to reverse either the guilty decision or the sentencing but these Rs actually upheld the law.

5) Mr. Libby will spend not one day in jail.

That adds up in my view to some powerful knowledge that is being protected. There are no words harsh enough in my mind to denounce this whole administration. This very case is why, in my opinion, Mr. Gonzales has held the support of Mr. Bush in the face of absolute demonstration of unworthiness. He needed to have a schill to get a legal rebuttal in place.

FACT: during the investigation of the outing of the cia agent, scooter lied and obsturcted the investigation, therefore he was not convicted of outing a cia agent, but lying and obstructing during the investigation. I know you will have trouble wrapping your tiny brain around this fact, because you probably still believe shrub and elmer that Iraq was involved in 9/11. Regardless of the wording, regardless of what may have been done right or wrong with the investigation and trial, all this tells me is that this President feels he and his people are above the law. Plain and simple. And it won't matter who wins in 2008. It will take us years to recover from the Bush administration.

Sorry Ashen.  The facts only show Libby gave conflicting testimony with regards to who he told what, when.  Period.  No one has presented evidence of adminstration officials conspiring to out Plame.  The facts are the facts.

A jury convicted Libby of OJ/perjury only AND any President can commute or pardon anyone except with regards to impeachment.  So the law IS being respected just like it was when Presidents Clinton through Washington pardoned and commuted sentences in cases they felt were correct.

Live with it.  There is no law being broken by Bush, there will be no coup and life goes on in our wonderful democracy!

Fine, then if Bush has no problem commuting the sentence of Libby, why not anyone else?  Let him commute the sentence of every single person in jail and prison.

Fact remains, Libby was convicted and the law was upheld until Bush commuted his sentence.  Yes he has that power, but the fact that he is using it to free one of his own shows how this administration feels itself to be above the rule of law and that there definitely is something to hide.

Through this and other actions this administration has shown itself to be wholly anti-American.  Anyone who continues to excuse this administration for every thing it has done need to stop and think: Is it more important to support ones party, no matter what the cost to one's country?  Or do these people just not care for what America stands for anymore?

These actions also bring the question as to whether or not we should start replacing the tradition of our government with actual laws, since this administration seems to treat both as 'quaint'.

When did I ever say Libby did not do what he was convicted of?  I posted regarding the overheated posts by people who claim President Bush is covering up a known conspiracy or overstepping his authority and ignoring the law.

Try using your brain to try to read people's posts a bit better and try to understand their point before you insult them.

Perjury and obstruction of justice are crimes of procedure and can be used by prosecuters to at least give some red meat to the crying lynch mob.  Obviously, the mod here wants blood and poor old President Bush robbed them of it.  Whatever happened to the values of compassion and love?
I laugh when I hear people say that there was no underlying crime committed during this whole sordid affair. I laugh and cry. The crime was pulled off by Cheney when he denied the truth concerning Joe Wilson's report. The Administration hammered away with "Saddam was trying to obtain nuclear material from Africa". This lie led directly to the death of my son, Marine Sgt. Matthew Fenton.
 I don't care about Libby; he was a nobody following the Mastermind's orders. The evil here is Cheney, Cheney,Cheney.

In my opinion, you are absolutely right re the facts of the case.

In my opinion, you are wrong re the implications of this commutation of sentencing.

It is your right to view the situation through the single lens of this one case.

It is my right to view this situation as yet another indication that this administration will never let anything as simple as the rule of law interfere with its own goals.
