Finally tonight, as promised, a Special Comment on the meaning of the story of former U.S. Acting Assistant Attorney General Daniel Levin.

It is a fact startling in its cynical simplicity and it requires cynical and simple words to be properly expressed:

The Presidency of George W. Bush has now devolved into a criminal conspiracy to cover the ass of George W. Bush.

All the petulancy, all the childish threats, all the blank-stare stupidity;

All the invocations of World War Three, all the sophistic questions about which terrorist attacks we wanted him not to stop, all the phony secrets;

All the claims of executive privilege, all the stumbling tap-dancing of his nominees, all the verbal flatulence of his apologists...

All of it is now -- after one revelation last week -- transparently clear for what it is: the pathetic and desperate manipulation of the government, the re-focusing of our entire nation, towards keeping this mock president, and this unstable vice president, and this departed wildly self-over-rating Attorney General -- and the others -- from potential prosecution for having approved or ordered the illegal torture of prisoners being held in the name of this country.

"Waterboarding is torture," Daniel Levin was to write.

Daniel Levin was no theorist and no protestor.

He was no troublemaking politician.

He was no table-pounding commentator.

Daniel Levin was an astonishingly patriotic American, and a brave man.

Brave not just with words or with stances -- even in a dark time when that kind of bravery can usually be scared -- or bought -- off.

Charged -- as you heard in the story from ABC News last Friday -- with assessing the relative legality of the various nightmares in the Pandora's box that is the Orwell-worthy euphemism "Enhanced Interrogation," Mr. Levin decided that the simplest, and the most honest, way to evaluate them... was to have them enacted upon himself.

Daniel Levin took himself to a military base and let himself be water-boarded.

Mr. Bush -- ever done anything that personally courageous?

Perhaps when you've gone to Walter Reed and teared up over the maimed servicemen? And then gone back to the White House and determined that there would be more maimed servicemen?

Has it been that kind of personal courage, Mr. Bush, when you've spoken of American victims and the triumph of freedom and the sacrifice of your own popularity for the sake of our safety? And then permitted others to fire or discredit or destroy anybody who disagreed with you -- whether they were your own Generals, or... Max Cleeland, or... Joe Wilson and Valerie Plame… or Daniel Levin?

Daniel Levin should have a statue in his honor in Washington right now.

Instead, he was forced out as Acting Assistant Attorney General, nearly three years ago, because he had the guts to do what George Bush couldn't do in a million years: actually put himself at risk for the sake of his country, for the sake of what is right.

And they water-boarded him and he wrote that even though he knew those doing it meant him no harm, and he knew they would rescue him at the instant of the slightest distress, and he knew he would not die -- still, with all that reassurance, he could not stop the terror screaming from inside of him, could not quell the horror, could not convince that which is at the core of each of us -- the entity who exists behind all the embellishments we strap to ourselves, like purpose and name and family and love -- he could not convince his being… that he wasn't drowning.

Water-boarding, he said, is torture.

Legally, it is torture!

Practically, it is torture!

Ethically, it is torture!

And he wrote it down.

Wrote it down somewhere, where it could be contrasted with the words of this country's 43rd President: "The United States of America... does not torture."

Made you into a liar, Mr. Bush.

Made you into, if anybody had the guts to pursue it, a criminal, Mr. Bush.

Water-boarding had already been used on Khalid Sheik Mohammed and a couple of other men none of us really care about -- except, Sir, for the one detail you'd forgotten -- that there are rules, and even if we just make up these rules, this country observes them anyway, because we're Americans, Sir, and we're better than that.

We're better than you.

And the man your Justice Department selected to decide whether or not water-boarding was torture, had decided, and not in some phony academic fashion, nor while wearing the Walter Mitty poseur attire of flight-suit and helmet.

He had put his money, Mr. Bush, where your mouth was.

So, your sleazy sycophantic henchman Mr. Gonzales had him append an asterisk suggesting his black-and-white answer wasn't black-and-white, that there might have been a quasi-legal way of torturing people, maybe with an absolute time limit and a physician entitled to stop it, maybe, if your administration had ever bothered to set any rules or any guidelines…

And then when your people realized that even that was too dangerous, Daniel Le Vin was branded "too independent" and "someone who could (not) be counted on."

In other words, Mr. Bush, somebody you couldn't count on to lie for you.

So, Levin was fired.

Because if it ever got out what he'd concluded, and the lengths to which he went, to validate that conclusion, anybody who had sanctioned water-boarding, and who-knows-what-else… anybody -- you yourself, Sir -- you would have been screwed.

And screwed you are.

It can't be coincidence that the story of Daniel Levin should emerge from the black hole of this secret society of a presidency just at the conclusion of the unhappy saga of the newest Attorney General Nominee.

Another patriot somewhere, listened as Judge Mukasey mumbled like he'd never heard of water-boarding, and refuse to answer in words… that which Daniel Levin answered on a water-board somewhere in Maryland or Virginia three years ago.

And this someone also heard George Bush say "The United States of America does not torture"... and realized either he was lying or this wasn't the United States of America any more, and either way, he needed to do something about it.

Not in the way Levin needed to do something about it, but in a brave way nonetheless.

We have United States Senators who need to do something about it, too.

Chairman Leahy of the Judiciary Committee has seen this for what it is and said "enough."

Senator Schumer has seen it, reportedly, as some kind of puzzle piece in the New York political patronage system and he has failed.

What Senator Feinstein has seen, to justify joining Schumer in rubber-stamping Mukasey, I cannot guess.

It is obvious that both those Senators should look to the meaning of the story of Daniel Levin and recant their support for Mukasey's confirmation.

And they should look into their own committee's history and recall that in 1973, their predecessors were able to wring even from Richard Nixon, a guarantee of a Special Prosecutor (ultimately a Special Prosecutor of Richard Nixon!), in exchange for their approval of his new Attorney General, Elliott Richardson.

If they could get that out of Nixon, you -- before you confirm the President's latest human echo tomorrow -- you better be able to get a "yes" or a "no"… out of Michael Mukasey.

Ideally you should lock this government down financially until a special prosecutor is appointed -- or fifty of them -- but I'm not holding my breath. The "yes" or the "no" on water-boarding will have to suffice.

Because, remember... if you can't get it, or you won't... with the time between tonight and the next presidential election likely to be the longest year of our lives, you are leaving this country, and all of us, to the water-boards -- symbolic and otherwise -- of George W. Bush.

Ultimately, Mr. Bush, the real question isn't... who approved the water-boarding of this fiend Khalid Sheik Mohammed and two others.

It is: why were they water-boarded?

Study after study for generation after generation, sir, has confirmed that torture gets people to talk, torture gets people to plead, torture gets people to break, but torture does not get them to tell the truth.

Of course, Mr. Bush, this isn't a problem, if you don't care if the terrorist plots they tell you about, are the truth... or just something to stop the tormentors from drowning them.

If, say, a President simply needed a constant supply of terrorist threats to keep a country scared…

If, say, he needed phony plots to play hero during, and to boast about interrupting, and to use to distract people from the threat he**didn't** interrupt…

If, say, he realized that even terrorized people still need good ghost stories before they will let a President pillage the Constitution…

Well, heck, Mr. Bush, who better to dream them up for you… than an actual terrorist?

He'll tell you every thing he ever fantasized doing, in his most horrific of daydreams -- his equivalent of the day you "flew" onto the deck of the Lincoln to explain you'd won in Iraq.

Now if that's what this is all about -- you tortured not because you're so stupid you think torture produces confession -- but you tortured because you're smart enough to know it produces really authentic-sounding fiction -- well, then… you're going to need all the lawyers you can find… because that crime wouldn't just mean impeachment, would it Sir?

That crime would mean George W. Bush is going to prison.

Thus the master tumblers turn, and the lock yields, and the hidden explanations can all be perceived, in their exact proportions, in their exact progressions.

Daniel Levin's eminently practical, eminently logical, eminently patriotic way of testing the legality of waterboarding… has to vanish -- and him, with it.

Thus Alberto Gonzales has to use that brain that sounds like an old car trying to start on a freezing morning, to undo eight centuries of the forward march of law and government.

Thus Dick Cheney, has to ridiculously assert that confirming we do or do not use any particular interrogation technique, would somehow help the terrorists.

Thus Michael Mukasey, on the eve of the vote that will make him the high priest of the law of this land, cannot and must not answer a question, nor even hint that he has thought about a question, which merely concerns the theoretical definition of water-boarding as torture.

Because, Mr. Bush, in the seven years of your nightmare presidency, this whole string of events has been transformed…

These actions by the White House to silence any and all critics are a potent attact on the very freedoms that are being sacrificed in the name of democracy by our soliders, like my son.  Mr. Olbermann provides another insightful look in the carniverous minds of the Bush White House and their need to dehumanize the ememy and make themselves into the saviors. These behaviors are a the classic example of the god complex.  Thank you Mr. Olbermann for bringing these facts to light in a media that is drowning trying to prop up this administration.

You are right on once again. You do more with your cmments than all the other supposed newscasters  to restore my faith in the fourth estate.              Wish you could give some thought to do a piece on "War Is A Racket" by deceased Marine General Smedley Butler. Tho it was written about wars prior to WWII it is an indi ghtment of the Iraq War and the obscene profits being enjoyed by industry.          This Iraq War is one where industry is not being taxed on excess profits. What a crime.

This was perhaps the most eloquent evisercation of the Bush administration I have ever seen.  As someone who has been incredibly angered and depressed by their unparalleled abuse of power I have often felt what you so articulately expressed and thus gained a lot of comfort from your words.
Our hero nails it again. You will one day get a Profile in Courage Award from Caroline Kennedy Schlossberg and it will be most richly deserved.

At last someone has said so eloquently what has needed to be said about the criminals who have taken over the presidency of this country. It is no surprise that Bush and his band of "handlers" and toadies have acted in this way, the surprise is that Congress has caved in so readily and so frequently even when the American public has time and time again showed them that it wants a change from the theocratic and fascist regime that has been created by this latter-day dictator. When I was a young boy I was always taught "scratch a bully,find a coward" and here we have not one but two cowards at the head of the current administration. One of which when it was his turn to offer his military service to his country, ran and hid in the Texas Air National Guard.(Complete military records NOT available upon asking!) and another who got at least FIVE deferments so he wouldn't have to bring his sorry behind to VietNam. These two cajones-less blowhards are quite willing to send young,brave,patriotic americans (all of which they are not) to die in a war they ramped up to make money for themselves and/or others like themselves. Personally, it would not surprise me if this coward would attempt to delay his departure from his presidency by claiming a martiial law situation because the barbarians are at the gate. Sort of what Giulliani explored when he was about to leave Gracie Mansion. Look for a ramping up of rhetoric against the "terrorist threat" right before he gets to the end of his term. Well shame on him for creating a false war and false reports of danger,shame on Congress for being too afraid to stop him,shame on the media for agreeing to help with the the selling of the war and and abdicating its responsibility to the public(Elmer Davis is spinning in his grave) shame on his parents for not teaching him common values and plain human decency, and lastly, shame on ourselves if we do not pursue a criminal investigation against this pretender to the Oval Office who never was and never will be a true American President.

Thank you for getting these monumental issues into the MSM. It's so easy to Deny,Deny,Deny..because it is Unthinkable in our Natioanl psyche. We lost the Executive Branch decades ago, Congress poisons it's fledglings with misconception that THEY RULE US. How many 'Humble Public Servants" can you think of. Now how many are just the whores of Corporations, (or faiths or just  in it for their own ego).As for the Supreme Court- they've been effectively nullified by the last 2 appointments.

You used to be so funny when you did sports. Don't know what happened or why you got sucked into the polarized political process. It's not really news since it is commentary and the reality most of the diatribes are merely Bush hating outbursts. From the comments on the diatribes the few people watching are Bush hating sycophants. I have withdrawn from the political process since I can't see the world in black or white terms which is required now. I like most live in a world of shades of gray, and can't relate to most involved anymore. You have become passionate and are eloquent but are so obviously fixated on spewing vitriole on one on person you obviously hate that you certainly cannot be trusted to be objective.

You are indirectly related to my disdain for all those in power or trying to be. I just happened to be surfing and settled on CSPAN for a moment just in time to hear Harry Reid quote you on the floor of the Senate. That was the final straw. I hope that once we get past Bush that you will join a 12 step recovery group and go back to sports where you are so good. The reality is the country is great enough to survive a bad president. At long last the timing and everything almost demands that this is why Gonzo was willing to torture AG Ashcroft in his hospital bed that night. I was trying to think of whet would get Gonzo to go there and Ashcroft to oppose him.

Ashcroft was never opposed to much and nobody outside the Gang of Pirates saw him as heroic, but the acts of Mr Levin would be just the thing to get the support of Ashcroft, and just the thing to get Gonzo to do what he did as well.

That whole Morality play makes total sense in that context.

We are 2 nations. As a student of history, this idea knocked me in the back of my head A LA "having a V8." Just as there was a "North" and a "South" during the Civil War, I believe we are 2 nations, 2 distinct countries. There is the country of those who were wonderfully described by a couple of tonight's guests on COUNTDOWN and Keith Olbermann in his "Special Comment" as "...lazy, stupid, and pseudo-tough...", "...pathetic, ideologically bankrupt, and incompotent,..." and apologists of "...verbal flatulence...". Do these traits sound like anyone we know around here of the troll-like persuasion? And, worse yet, there are Democratic members of the Senate Judiciary Committee, namely Senators Schumer and Feinstein, who are ready to capitulate AGAIN to this ilk in an irrational fear of being portrayed as being "soft on terror" if Mr. Mukasey's nomination is derailed.

Then, we have the other "America," depending on which poll you read, the other 70-80%, the America with people like Daniel Levin, the JAGs who sent the waterboarding letter to the committee who will give the "thumbs up" or "thumbs down" Mr. Mukasey's nomination (who cares if they're lawyers?! aren't they in the military, too???!!!), the expert on Pakistan, Iran, and other areas of the Middle East, Keith Olbermann, who rightly called out members OF BOTH PARTIES to protect and defend the Constitution as they vowed in their oaths and to not be afraid to USE THEIR CONSTITUTIONALLY GRANTED POWERS to bring the REAL UNITED STATES back from a brink that will forever sully our image and reputation all over the world for years to come, and the 90% of us NewsHolers who love our country and will not be bullied into hiding away, being afraid, or being silent about wrongs being committed in our name.

Go out and do your civic duty on Election Day no matter what the weather is (crappy here - check local listings), no matter what mood you're in, etc.; hopefully, most here don't have archaic "Election Day Blue Laws" dictating no alcohol sales before 6:00. Sure there's the not showing up drunk at your polling place concern, but if you need a "good belt" on any day, it's Election Day! I'm beginning my civic duty tonight to send Keith's "Special Comment" to my senators, Senators Schumer and Feinstein, and everyone else I have the energy to send it to. If you feel the same way I do, YOU DO THE SAME; if you disagree with me, let your representatives know, too. Keith, tonight's "Special Comment" produced another joyous leap and a Whitman-esque "Barbaric Yaup" from yours truly. BRAVO, Keith Olbermann! You speak truth to power like no one else in the business! You're the only newsman or woman out there holding this criminal administration's feet to the fire and I only wish that you could go down to Washington and personally reprimand Congress for failing to do its duty to hold BushCo to account.

A vast number of the American public blindly believes ANYTHING he says to be gospel.  Why will NO ONE hold him accountable for the LITANY OF CRIMES HE'S COMMITTED?!! Who will call him out!?  Congress has been bought by the lobbyists.  The system is broken.

IT SHOULD BE OF NO SURPRISE THEN THAT AS OUR PRESIDENT HAS ZERO INTEGRITY THAT THE VALUE OF OUR CURRENCY SHOULD FALL!!!!!  Even supermodel Bundchen is smart enough to keep her currency in anything but dollars.

My father being Canadian, I've had a close relationship with their currency.  Today our exchange rate is the lowest it's been in 30 YEARS!  You can't get even ONE LOONIE with your dollar today!

If this country wants to restore the value of their currency and promise (on some level the same thing) then George Bush needs to be HELD ACCOUNTABLE for WAR CRIMES and TREASON!!!

Very nice comment Keith.  It is truly a shame that the sheep of the United States will do nothing but pray to their gods for the souls of those that have been hurt, and not care otherwise about anything.  The attention span of the above average and less U.S. citizen doesn't care about what happens beyond their front yard.  We are a nation of cattle with blinders on, and nothing can stop that now.  It is why our politicians are fat, and don't care about anything but their own hides!

Kudos to you Keith, but nobody is listening... At least noone that will do anything.  The next president will be just as corrupt no matter what side of the aisle they come from.  I only hope it isn't Rudy, the one man that will make me reconsider citizenship!

Thank you, Keith for and from all of us Americans.  
Now, for the hard part:
Is there anyone in America with the courage AND the power to actually bring a formal complaint--where, Congress? federal court? the World Court?--and actually have this criminal act charged and prosecuted?
To call it out and not have any real action taken is just noise, no more effective than that of the Fox Noise Channel.

Thanks Keith! I called Senator Feinstein (my rep) to tell her that if she votes for this AG, she is immoral and unethical! No free pass for any politician who votes to approve this AG, who knows that water boarding is truly an act of torture. We Americans deserve better!
To All Trolls: What part of toture is an ineffective and UNRELIABLE means of gathering information don't you understand? WHAT PART OF UNRELIABLE DONT YOU UNDERSTAND?
I know torture must have an appeal to the reptilian parts of your brains, but jeez do you have to make it so obvious?

It takes real guts to do what you do. I would not be surprised if Georgieboy sicced more of his dogs on you. Or would have you rendered and waterboarded too.
